How would you handle this problem with a bad eBay seller?

You could open a dispute. how in the hell could he sue you when he is the one who ****** up. There are alot of dumbes in ebay and I have went through the same thing with bad ebayers and what sucks even more is you can't get a refund. It's screwed up!
